Cookie Policy - Information on the processing of personal data of platform users pursuant to Article 13 of EU Regulation 679/2016 (GDPR)
 

ABI Servizi SpA (hereinafter also “ABI Servizi”) aims to provide, pursuant to and for the purposes of Art. 13 of Regulation (EU) 2016/679 - General Data Protection Regulation (hereinafter “GDPR”) and Legislative Decree 101/2018, which supplements and amends Legislative Decree 196/2003 (known as the Privacy Code), some information on the processing of personal data relating to the user (“data subject”) acquired or communicated by means of “Cookies” while browsing on this platform (hereinafter, for brevity, “Site” or “Platform”).

This cookie policy refers exclusively to this platform (hereinafter, for brevity, the “Site” or “Platform”) and must be understood as being an integral part of its Privacy Policy.

1. DEFINITIONS, CHARACTERISTICS AND APPLICATION OF RULES

Cookies are small text files that are sent from sites that the user visits and stored on the user's computer or mobile device, to be then sent back to those sites during subsequent visits. It is precisely because of cookies that a site remembers the user's actions and preferences (for example, login data, preferred language, font size, other display settings, etc.) so that they do not have to be set again when the user returns to that site or navigates from one page to another within it. Cookies are therefore used to perform digital authentication, session monitoring and storage of information on the activities of users accessing a site, and may also contain a unique identification code that makes it possible to track the user's browsing within the site for statistical or advertising purposes. While browsing a site, the user may also receive on their computer or mobile device cookies from sites or web servers other than the one he/she is visiting (“third party” cookies). Some operations may not be executable without the use of cookies, which in some cases are therefore technically necessary for the functioning of the site.

There are various types of cookies with differing characteristics and functions, and these may remain on the user's computer or mobile device for varying periods of time: session cookies, which are automatically deleted when the browser is closed; and persistent cookies, which remain on the user's device until a set expiry date.

Under current Italian law, the use of cookies does not always require the user's express consent. Such permission is required in particular by “technical cookies”, i.e. those used for solely for the transmission of a communication over an electronic communications network, or required only as strictly necessary to provide a service explicitly requested by the user. In other words, these are cookies that are essential for the operation of the site or are necessary to perform activities requested by the user.

Technical cookies not requiring express consent also include:

  • “analytics cookies”, when used directly by the site operator to collect aggregated information on the number of users and how they visit the site;;
  • browsing or session cookies, which ensure normal browsing and use of the website (such as making a purchase, or authentication for access to reserved areas);
  • • function cookies, which allow the user to browse based on a series of selected criteria (such as language, or the products selected for purchase), in order to improve the service provided to the user.

Prior user consent is however required for “profiling cookies”, i.e. those used for creating user profiles and for sending advertising messages in accordance with the user’s preferences expressed when browsing the web.
